Vigattin Radio on the Cyber Crime Law

Child pornography, hacking, phishing, online identity theft, cybersquatting, unauthorized use of someone else's data, libel and many more; as members of the growing population of the social media, we all heard of these. Most of us did these and many more are destroyed by these. But in the light of the Cyber Crime Law, these things shall soon end.

Ms. Janette Toral, one of our respected guests for that morning, shed light on the Cyber Crime Law, its nature, its importance and its nitty-gritty details. Ms. Edlyn Co of World Citi Colleges was also there to join in the discussion.

RA 10175 or the Cyber Crime Law entitles all Filipinos to a secured and responsible use of the inernet. It is the first law in the Philippines which specifically criminalizes cyber crime, which prior to the passage of the law had no strong legal precedent in Philippine jurisprudence. It emphasizes the power of the law enforcing bodies and enables the police to gather data of an involved individual from the defending entity immediately after 72 hours by the effect of a court order; missing essentials on the previous RA 8972 (E-Commerce Act) and the RA 10173 (Data Privacy Act).

The maximum penalty mentioned on the Act is up to PHP 5,000,000,000 and up 6 months to 12 years of imprisonment when a minimum of 100 data are affected by the crime committed by an individual. The penalty rises though if the crime committed was of corporate entities or comapnies. As the episode ended, Ms. Janette Toral, stated that the internet is made not to ruin other people's lives. We should be responsible of our every actions on the internet. A reason why these kinds of law are implemented is not just to bring justice and to prevent crime but also to push a reponsible use of the internet.
